Creating a Foundation

A foundation is an organisation, that can be regarded as an autonomous legal entity which belongs to itself. It has characteristics of a company, however, it acts more like a trust.

A Maltese foundation can be created by public  deed or through a will and obtains separate legal personality once the foundation is registered with the Registrar for Legal Persons.

Creating a Trust

A trust is a relationship created through a private writing, by which the settlor transfers assets to the trustee to be held for the benefit of beneficiaries or for a charitable purpose.

The trustee is usually a firm or company engaged professionally and customarily in the business of trustee services and in managing assets, which are legally owned by the said trustee, but subject to the provisions of the trust instrument, which is kept by the trustee and is not registered anywhere.
